These Terms govern access to the website boostproduction.ro and any service, software, calibration file or content (collectively, the "Services") supplied by BOOST PRODUCTION SRL (the "Company", "we", "us"). By accessing the site, creating an account, uploading a file or placing an order, you ("Client") accept these Terms in full. If you do not accept them, do not use the Services.
1. Nature of the Services
The Services consist of off-the-shelf software development work — namely the modification of electronic control unit (ECU/TCU) calibration files supplied by the Client. We deliver a software file. We do not sell vehicles, vehicle parts, road-legal modifications or any guaranteed performance outcome.
All work is supplied for off-road, motorsport, closed-course, research, diagnostic or export use only, unless the Client provides documented homologation for road use in their jurisdiction. The Client is solely responsible for determining the legality of installing or using any file in any country.
2. Client representations & warranties
- The Client is the lawful owner of the vehicle and of the original ECU file, or is fully authorised by the owner.
- The vehicle hardware is mechanically sound, with no pre-existing fault, wear or modification that may compromise the result.
- The Client has independently verified the legality of the requested modification in the country of registration and use.
- The Client will retain an unmodified copy of the original (stock) file at all times.
- All information provided (make, model, engine code, ECU hardware/software ID, year) is accurate and complete.
Any misrepresentation voids any commitment we may otherwise have, including refunds, re-work and support.
3. File delivery, revisions & rejection
Lead times are estimates only and are not contractual. We may reject any order at our sole discretion — including, without limitation, where the file appears corrupted, where the hardware is unsupported, where there is a suspicion of theft or fraud, or where the Client's intended use is unlawful. Rejected orders are refunded to the original payment method.
Where a delivered file does not meet a documented technical specification we have explicitly confirmed in writing, we will at our discretion revise or replace the file. Re-work is the Client's sole and exclusive remedy.
4. Installation, flashing & operation
We deliver a file. Installation, flashing, ECU programming, datalogging, on-vehicle testing and any consequential mechanical, electronic or chemical effect on the vehicle are performed by the Client or its chosen installer, entirely at the Client's risk. The Client agrees that ECU flashing carries inherent risk of bricking, data loss, immobiliser lockout, sensor failure, drivetrain stress and other damage, and accepts that risk in full.
5. Warranty disclaimer
To the maximum extent permitted by law, the Services are provided "AS IS" and "AS AVAILABLE", without warranty of any kind, whether express, implied, statutory or otherwise, including without limitation any warranty of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, road-legality, emissions compliance, fuel economy, durability, compatibility with future updates or any specific power, torque or performance figure. Any indicative numbers shown on the site, dyno charts or marketing material are estimates derived from reference vehicles and do not constitute a representation, guarantee or contractual specification for the Client's vehicle.
6. Limitation of liability
To the maximum extent permitted by applicable law, the Company, its shareholders, directors, employees, contractors and tuning partners shall not be liable for any direct, indirect, incidental, special, consequential, punitive or exemplary loss or damage of any kind, including without limitation:
- damage to the engine, gearbox, turbocharger, DPF, catalyst, injectors, clutch, drivetrain, sensors, wiring, ECU or any other vehicle component;
- loss of vehicle use, hire car costs, towing, recovery, repair, diagnostic or storage costs;
- loss of manufacturer or extended warranty, insurance coverage, leasing/financing terms, type-approval, road-worthiness certificate (ITP/MOT) or registration;
- fines, penalties, taxes, emissions or noise-test failures imposed by any authority;
- personal injury or death arising from the use of a modified vehicle (save where liability cannot be excluded by law);
- loss of profit, revenue, business, goodwill, anticipated savings or data;
- damage caused by the Client, its installer or any third party during reading, flashing, wiring or operation.
The aggregate liability of the Company, for any and all claims arising out of or in connection with the Services, is strictly limited to the amount actually paid by the Client for the specific Service that gave rise to the claim, in the six (6) months preceding the event. This cap applies in contract, tort (including negligence), strict liability and any other theory of liability.
Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, or any other liability that cannot be excluded under mandatory Romanian or EU consumer law.
7. Indemnity
The Client agrees to indemnify, defend and hold harmless the Company against any claim, proceeding, fine, damage, cost or expense (including reasonable legal fees) brought by any third party — including the vehicle manufacturer, lessor, insurer, authority, passenger or subsequent owner — arising out of the Client's use, installation, resale or operation of any file delivered under these Terms.
8. Intellectual property
Calibrations, methodologies, scripts, definitions and any derived work remain the exclusive property of the Company. The Client receives a non-exclusive, non-transferable licence to use the delivered file on the single vehicle identified at the time of the order. Resale, redistribution, reverse-engineering, decompilation or any commercial reproduction is strictly prohibited.
9. Pricing, payment & taxes
Prices are displayed in the applicable currency, exclusive or inclusive of VAT as indicated. Payment is due in full before file delivery. We reserve the right to change pricing at any time without notice. Bank, card-processor and currency conversion fees are borne by the Client.
10. Statutory consumer right of withdrawal (EU)
Where the Client qualifies as a consumer under EU law, they may have a 14-day right of withdrawal under Directive 2011/83/EU. By placing an order for a digital file or a customised service and expressly requesting that work begin immediately, the Client acknowledges and accepts that the right of withdrawal is lost once execution of the order has begun, in accordance with Article 16(a) and 16(m) of the Directive and Romanian OUG 34/2014.
11. Force majeure
We are not liable for any delay or failure caused by events beyond our reasonable control, including without limitation power outages, network failures, hardware failure, supplier or slave-tool outages, public authority action, war, strike, pandemic or natural disaster.
12. Governing law & jurisdiction
These Terms are governed by the laws of Romania. Any dispute that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the competent courts of București, Romania, without prejudice to any mandatory consumer protection right granting the consumer the right to seise the court of their domicile.
13. Changes
We may amend these Terms at any time by publishing a new version on this page. The version in force at the time the order is placed governs that order.
